If you're a leaseholder fed up with your managing agent, the Right to Manage (RTM) might be your legal ticket to finally take control of your building — without buying the freehold.

In this article, we break down what RTM is, who can use it, and how the process works.

🔍 What Is Right to Manage?

Right to Manage (RTM) is a legal right under the Commonhold and Leasehold Reform Act 2002 that allows leaseholders to take over the management of their block — even if the freeholder doesn’t agree.

Instead of paying high service charges for poor service, leaseholders can form an RTM company and take charge of:

  • Building maintenance
  • Service charge spending
  • Contractor selection
  • Day-to-day block management decisions

âś… Who Can Use RTM?

RTM is available to leaseholders of residential buildings that meet a few criteria:

  • The building is self-contained and has at least two flats
  • At least two-thirds of the flats are leasehold (not rented by the council)
  • 50% or more of the leaseholders want to take part
  • The building is not a mixed-use development with too much commercial space (more than 25%)

🛠️ How Does the RTM Process Work?

Here’s a simplified version of the typical RTM journey:

1. Eligibility Check

Confirm your building qualifies (we offer this for free).

2. Form the RTM Company

A formal company is created to take over the management rights.

3. Serve Legal Notices

Section 78 & 79 notices are served to the freeholder and current managing agent.

4. Wait Out the Notice Period

After the notice period (typically a few months), the management rights transfer.

5. Take Over the Building

The RTM company becomes the legal manager — you’re now in charge.

đź’ˇ Most groups hire a professional agent (like Neon) to handle management after the RTM process is complete.

đź’¬ Is It Complicated?

It can be — especially the legal and compliance bits — but that’s exactly why we created the Neon RTM Freedom Plan™.

We handle the legal side, form your company, manage the notices, and take over the building professionally once you gain control.

🎯 Why Leaseholders Choose RTM

  • More say in how service charges are spent
  • Transparent budgets and real contractor quotes
  • Repairs done when needed, not when convenient
  • The power to replace poor managing agents
